How a Claim Moves

Four Steps, Start to Resolution

From your free case review through settlement or trial, we handle the claim so you can focus on getting back on the road.

Step 1: Free Case Review

Send your repair orders and purchase paperwork. We assess your claim at no cost.

Bring us whatever you have — repair orders, your purchase or lease agreement, warranty documents, even text messages or emails with the dealership. There's no minimum amount of paperwork required to get started; if records are incomplete, we can help you request them directly from the dealer or manufacturer. This step is always free and comes with no obligation to move forward.

What to gather

  • Purchase/lease agreement
  • All repair orders (even from different dealers)
  • Warranty booklet
  • Any manufacturer case/reference numbers

Step 2: We Build The Case

A formal demand goes to the manufacturer, backed by your repair history.

Once we've reviewed your documentation, we assemble a formal written demand that lays out the defect history, the number and length of repair attempts, and the relief you're entitled to under state law. This demand puts the manufacturer on formal legal notice and starts the clock on their obligation to respond.

What happens behind the scenes

  • We calculate your potential recovery (including mileage offset for buybacks)
  • We identify the strongest legal theory for your case
  • We package the evidence so the manufacturer can't easily dispute the timeline

Step 3: Negotiate or Litigate

Most claims settle. When one doesn't, we're prepared to take it to trial.

The majority of manufacturers respond to a well-documented demand with a settlement offer, and we negotiate from there to get you the strongest outcome. If a manufacturer refuses to negotiate in good faith, we're prepared to file suit and litigate — including taking the case to trial if necessary. You're kept informed at every stage, and nothing is accepted on your behalf without your sign-off.

Timeline

Straightforward buyback claims often resolve in a matter of months; contested or litigated cases can take longer, but our clients pay nothing out of pocket while we work.

Step 4: You Get Paid

A refund, replacement, or cash settlement — the manufacturer typically covers our fees.

Under the Song-Beverly Act, a manufacturer that loses (or settles) a lemon law claim is generally responsible for the consumer's attorney's fees and costs — meaning our fee typically doesn't come out of your settlement. You walk away with your refund, replacement vehicle, or cash payment, and we handle the paperwork to close out the claim.
